Deborah A. Cmielewski is an associate in the Health Law Practice Group of Brach Eichler L.L.C.. She is resident in the firm's Roseland office. Her practice includes the representation of health care professionals, group practices, medical societies and hospitals in a variety of corporate, transactional and regulatory matters. Ms. Cmielewski advises on the structure and formation of health care entities, shareholder, operating and employment agreements, mergers and acquisitions. Ms. Cmielewski also engages in the preparation, review and negotiation of managed care agreements. Her practice regularly involves the analysis of pending and current legislation and rules, including fraud and abuse, Medicare and other issues.
Ms. Cmielewski also maintains a practice representing both professionals and corporate entities in administrative, licensing and regulatory proceedings before professional boards and governmental agencies. She regularly counsels clients in both health and non-health related professions in agency matters, from the complaint phase through and including dispute resolution. She has represented a wide array of licensed professionals and entities, including physicians, dentists, hospitals, day care centers, veterinarians, accountants, funeral directors, real estate brokers and agents, health clubs and others.
Ms. Cmielewski previously served as a Regulatory Analyst and then as Chief of Regulatory Affairs for the New Jersey State Division of Consumer Affairs. In that capacity, she managed and staffed the unit responsible for writing the New Jersey Administrative Code for the professional boards, Bureau of Securities, Office of Weights and Measures and the Office of Consumer Protection. Her position included the preparation of regulations and policy statements for publication as well as the regular interaction with the professional boards and the Offices of the Attorney General and Administrative Law and members of the regulated community.
Ms. Cmielewski is the co-author of "Do You Need A Compliance Plan?" which appeared in the Bulletin of the Essex County Medical Society, as well as a contributing author for "The Biggest Legal Mistakes That Physicians Make and How To Avoid Them," currently available through SEAK, Inc. She has also lectured on health care topics, including discharge planning and guardianships.
Active in the community, Ms. Cmielewski sits on the Roseland Zoning Board of
Adjustment, she is the secretary for the Eagle Rock Condominium Association and
has been a member of the Roseland Republican County and Campaign Committees for
several years. Ms. Cmielewski served as the Campaign Manager for three
republican candidates who were elected to the Roseland Borough Council in
November, 2007 and currently serves as the Campaign Manager for the two 2008
republican candidates.
Ms. Cmielewski is also a member of the Literature Review Committee of Planned Parenthood of Greater Northern New Jersey, Inc. She has served as a member of the Roseland Mayor's Advisory Committee, the NAAG Telecommunications Task Force, the NAAG Health Law Task Force, as a special representative to the Roseland Planning Board, as a trustee, president and member of the Legal Committee of the Holmehill Association and as a volunteer court mediator, Morris County. She is also a former Pupil and Barrister in the Arthur T. Vanderbilt Inn of Court.
Ms. Cmielewski received her B.B.A. in finance, magna cum laude, from Pace University in 1989 and her J.D. from Seton Hall University School of Law in 1995. She is admitted to practice in New Jersey and before the U.S. Court of Appeals for the Third Circuit.
