Anthony Gruppuso is a member in the Litigation Department.  He has represented clients in a variety of complex disputes in federal and state court involving contracts, fraud, professional malpractice, attorney ethics, corporate law, commercial law and bankruptcy.

Prior to joining Brach Eichler in March 2011, Anthony was a director in the Business & Commercial Litigation group at Gibbons P.C., where he practiced for more than 10 years after completing two judicial clerkships.

REPRESENTATIVE MATTERS

• Representing a neurosurgical and orthopaedic medical practice in litigation and injunction proceedings against two former employees for breach of restrictive covenant, unfair competition and violation of New Jersey's computer offense law.
• Prosecuting successfully an IURO appeal on behalf of an insured who had been denied coverage, on medical-necessity grounds, for human growth hormone treatment.
• Representing the recipient of alleged fraudulent transfers made by chapter 7 debtor in connection with his application to vacate a seven figure judgment obtained by the trustee, which resulted in a settlement at a substantial discount for the client.
• Representing the trustee for the chapter 11 estates of  numerous real estate entities utilized by insiders to perpetrate a billion dollar Ponzi scheme founded on the sale of tenant-in-common investments.
• Defending an international accounting firm against a hospital's claims that the firm committed fraud and malpractice in assisting in the preparation of Medicaid cost reports.
• Defending an international accounting firm against a taxpayer's claims that the firm committed fraud and malpractice in the preparation of federal tax returns.
• Defending the sole shareholder of the distributor of an ephedra-based dietary supplement in one of the largest bankruptcy cases in New Jersey history.
• Representing one of New Jersey's largest real estate developers in arbitration proceedings at which ownership of more than 100 commercial and residential properties were at issue.
• Defending a national law firm against a motion to disqualify the firm from ANDA litigation.
• Representing a children's education-entertainment company in a dispute with its controlling shareholder involving claims of breach of contract and breach of fiduciary duty.
• Defending one of the world's largest technology and manufacturing companies against UCC claims brought by a seller of chemical compounds.

ADDITIONAL NOTEWORTHY INFORMATION

After graduating from Seton Hall University School of Law, with honors and as a member of Seton Hall Law Review, Anthony served as a law clerk to the Honorable Dorothea O'C. Wefing, J.A.D. of the Superior Court of New Jersey, Appellate Division.  He then went on to clerk for the Honorable Frederick J. Sculling, Jr. Chief United States District Court Judge for the Northern District of New York.

Anthony was named a New Jersey Super Lawyers Rising Star in 2006, 2007, 2008 and 2009.
