Real Estate Member Alan Hammer was re-appointed to the board of the New Jersey Apartment Association.
Health Care Member Keith Roberts served as moderator for the New Jersey Institute for Continuing Legal Education at the annual No-Fault Insurance PIP/ College on January 16 and Member Mark Manigan was a panelist. Roberts delivered a comprehensive update to 150 attendees concerning amendments to the PIP regulations as proposed by the NJ Department of Insurance and Manigan delivered an update of current regulatory issues facing ambulatory surgery centers throughout New Jersey.
Health Care members Joseph Gorrell and Carol Grelecki will speak on February 11 about employment contracts to the Committee of Interns and Residents, which educates residents about issues they will face when they enter practice.
Partners for Women and Justice recognized two Brach Eichler attorneys, Lindsay Cambron and Sean Smith, for their pro bono efforts to help low income and abused women and their children in 2011.
John Fanburg will provide an update on health care issues on a federal and state level impacting New Jersey radiologists at the Breast Imaging Symposium of the Radiological Society of New Jersey on February 25-26.

In an article in the December 1, 2011 issue of BNA's Health Law Reporter entitled "Physicians Improperly Terminated by Plans Because of Hospital Affiliation, Suit Claims," Brach Eichler's Sean Smith, who represented the physicians involved in the case, was quoted as saying that "the action was necessitated by Horizon's decision to put its business and profits ahead of the delivery for superior medical services to the Paterson and Passaic County public and was filed to vindicate a physician's right to practice and a patient's right to choose their physician". Charles Gormally was lead counsel in the matter.
The Somerset County Commission on the Status of Women has selected Brach Eichler's Susan Rubright as its 2012 "Lawyer of the Year."

The Borough Council of the Borough of Mountain Lakes unanimously elected Brach Eichler Member Charles X. Gormally to another term as Mayor during its annual reorganization meeting. Mr. Gormally, a Certified Civil Trial Attorney, is a member of the Executive Committee of the law firm of Brach Eichler L.L.C. in Roseland, NJ, where he also serves as Chairman of the Litigation Practice.

Consumer Fraud Judgment Against Auto Dealer
Anthony Rainone obtained a judgment in favor of his client, who alleged he was the victim of consumer fraud committed by a northern New Jersey auto dealership, Richard Catena Autowholesalers, Inc., arising out of the purchase of a Rolls Royce. (read more)
Third Circuit Affirms Dismissal of Suit Against Doctor
Brach Eichler successfully defended a doctor charged with civil rights violations after making a fitness for duty recommendation following a steroids testing of police officers. (read more)

Class Action Lawsuit Against Horizon Blue Cross/Blue Shield
Brach Eichler L.L.C. filed a putative class action lawsuit against Horizon Blue Cross/Blue Shield of New Jersey on behalf on the IPA of North Jersey, an independent practice association of physicians affiliated with St. Joseph's Regional Medical Center. The lawsuit seeks an injunction to prevent Horizon from terminating certain physicians from the Horizon network for seemingly no reason, other than that the doctors are affiliated with St. Joseph's.
Brach Eichler's Sean Smith, counsel for the IPA, said "This action was necessitated by Horizon's decision to put its business and profits ahead of the delivery of superior medical services to the Paterson and Passaic County public. We filed this action to vindicate a physicians' right to practice and a patients' right to choose their physician." Charles Gormally is counsel of record on the case.

Brach Eichler Presents Second Annual Burton L. Eichler Award

Brach Eichler Noted for Involvement in Multifamily Transactions in Montclair and Union City
Allen Popowitz represented the seller and buyer in a rare multifamily transaction in Montclair, a 29-unit building that sold for $3.45 million. Jeffrey Itzkowitz represented the buyer in a $2.25 million sale of a 28-unit apartment building in Union City.
Client's Right Upheld as "Highest and Best Bidder"
The Appellate Division ruled today upholding the right of our client, a group of physician investors, to be declared the "highest and best bidder" even though the client paid $1.8 million less than the highest bid for a commercial property, an office building in dispute. The ruling allows our client to complete the purchase of a fantastic commercial property in Bergen County and construct a medical facility there.
Brach Eichler's Real Estate Practice Group recently completed the second largest deal in its history. The team, led by Allen Popowitz, closed the acquisition of 5,000 apartment units located in thirteen properties spread out over Ohio, Indiana and Pennsylvania. This highly complex deal involved loans in default, properties in distress and in the hands of various receivers, and acquisition funds from various sources.
The Highlands Water Protection and Planning Act, passed in 2004, was intended to preserve open spaces and protect natural resources. It also has had the effect of shutting down development of any kind in many municipalities in Northern and Central New Jersey. On behalf of a client who wanted to develop a lot she owned, Member Susan Rubright succeeded, after nearly two years, in guiding the client through the process and overcoming numerous obstacles placed by the New Jersey Department of Environmental Protection, which granted the client a rare exemption.

Litigation Partner Alan Bernstein obtained a unanimous ruling on June 21, from the New Jersey Supreme Court in Abouzaid v. Mansard Gardens Associates, L.L.C., vindicating a client's position which was adverse to their insurance carrier in a hard-fought and closely-watched dispute by the insurance industry. The decision of the Court reversed the Appellate Court decision and reinstated a trial court ruling awaiting legal fees to Alan for his insistence that the insurance company provide a defense and coverage to his client, and awarded the firm attorney fees because the carrier had wrongfully refused to do so. The case is noteworthy becuase it provided the Court with an opportunity to explain and expand the law dealing with recovery of emotional distress damages and how an insurance carrier should treat a request for coverage and defense. Alan led the Brach Eichler team, which included litigators Stuart Polkowitz and David Klein.

The Brach Eichler Real Estate Tax Appeals group filed approximately 1,300 appeals in 2011 (on $2.5 billion in assessed property value), an increase over the prior two years, which were widely recognized as record-setting years for the number of appeals filed with the Tax Court of New Jersey. Additional appeals will be filed in April as the filing deadline has been extended to May 1 for revalued/reassessed municipalities.

Plaintiffs have brought action against the city of Hoboken, the Hoboken Rent Leveling and Stabilization Board, and other involved parties asking the court for damages and to stop the rent calculation process. Kevin M. Lastorino, member of the Health Law Practice Group, closes a $45 million sale of three nursing homes and an assisted living facility from a non-profit health care provider to two groups of affiliated for-profit entities. The transaction, which began with an open bidding process about one year ago, included a rigorous review by the Office of the Attorney General under the cy pres doctrine as required by the conversion of non-profit assets to for-profit uses. Mr. Lastorino has represented clients in the purchase and sale of nearly $92 million in skilled nursing and other long term care facilities and assets over the last 18 months.

The Appellate Division delivered a resounding victory to the provider community, protecting them from endless and harassing requests for confidential business information while "investigating" whether providers should receive payment for services. In a case handed down today in which Brach Eichler represented a group of medical providers, Selective Insurance Company v Hudson East Pain Management, the court instructed insurance carriers that they are not entitled to bully PIP medical providers into producing information beyond that expressly allowed by statute. Mark Manigan, Charles X. Gormally and Sean Alden Smith represented the interests of the medical provider community.

University Orthopaedic Associates, LLC, along with other partners, purchased a 59,000 sq. ft. office building in Franklin Township, NJ. Following a multi-million dollar renovation to convert the building to medical office space, University Orthopaedic Associates and its affiliates will lease space in the building for its medical offices, a surgery center, imaging and physical therapy. In Moore v. Fernandez, the Superior Court of New Jersey Appellate Division affirmed the determination of the trial court and ruled that arbitration agreements between obstetricians and their patients are not enforceable per se. The Appellate Division further found that,under the particular circumstances, the agreement in question was not enforceable. Joseph Gorrell, John Fanburg and Lauren Fuhrman of Brach Eichler were attorneys for amicus curiae Medical Society of New Jersey.

Pursuant to recent amendments to N.J.S.A. 25:1-5(h), all palimony agreements in New Jersey must be in writing. The New Jersey Superior Court, Appellate Division has been asked in two recent decsions to determine whether the amendment is to be applied prospectively and retroactively. Trial courts have conflicted on this issue resulting in serious consequences for cohabitants seeking support for oral agreements reached prior to the statute's amendment.

However, the court appears to have deviated from the standard in Newburgh v. Arrigo, 80 N.J. 529, 545 (1982) holding that a child's assets may not be used to fulfill a financially able parent's support obligation to fund college expenses.

The New Jersey Superior Court has certified a class action lawsuit against the city of Hoboken by a cadre of the city's past and present landlords of multifamily properties. The suit also names Hoboken Rent Leveling and Stabilization Board, the board administrator, mayor and city council. Brach Eichler's Charles Gormally represents the owner of approximately 8,000 rental units in the case.

In a complaint filed on behalf of all Hoboken multifamily property owners whose rental units are regulated by the Hoboken rent control ordinance, the Superior Court of New Jersey recently certified the complaint as a class action and approved Charles Gormally and Brach Eichler as plaintiff's class action lead counsel. The class action lawsuit seeks to vindicate the class members' rights which have been violated through the unconstitutional enforcement and administration of the rent control ordinance.
