Guidance Provided by DCA for Calculating the Electric Vehicle (EVCS) Parking Set-Aside Requirement

The Department of Community Affairs (DCA) has issued guidance that the EVCS requirement does not apply to offsite parking, applies only to new parking created for multiple dwelling units of 5+ and that EVCS installed under prior law will count towards the total required. The guidance clarifies that the “required” parking used to calculate the EVCS set-aside is based on the parking required by municipal ordinance even if the final site plan provides additional parking. Also, if a developer has received a variance from the zoning required parking, the EVCS set-aside will be based on the lower approved number of spaces not the required number.
