Self-Certification Program for Design Professionals Approved in NJ

In an effort to ease the burdens on municipalities in reviewing construction permit applications, and on builders and residents for the often prolonged delays by municipalities in reviewing and issuing such permits, the New Jersey Design Professional Self-Certification Act (A4360/S3402), has been signed into law. This  Bill requires the Department of Community Affairs (“DCA”) to develop a “design professional self-certification program” that will then allow approved architects and engineers to self-certify that construction application permits comply with the State Uniform Construction Code (UCC) and other applicable laws. Notably, the “qualified design professionals” must satisfy certain DCA requirements to qualify for this designation.  Municipal enforcing agencies are required to accept self-certified applications from qualified design professionals. DCA will be authorized to conduct random audits of the “qualified design professionals” to review whether they are  complying with the UCC and other applicable laws.
