Eric Magnelli’s practice is designed and implemented to avoid lawsuits, allowing his client’s to devote their time and energies on their business and family. However, when lesser means have failed or cannot reasonably be employed, Eric’s extensive experience as a trial lawyer protects his clients’ interests with the same vigor and resolve that made him a Sergeant in the U.S. Marine Corps Infantry.

Eric concentrates his practice on labor and employment matters and a broad range of complex commercial litigation, construction disputes and contract interpretation. He counsels, investigates and litigates a wide range of labor and employment matters such as discrimination, harassment, whistleblowing, discipline and discharge, layoffs, collective bargaining agreements, reasonable accommodations, compliance with state and federal family and medical leave laws, applicable wage and hour laws, ERISA and OSHA regulations and also conducts training in these areas for executives, directors, managers, supervisors, and employees.  Eric drafts and provides advice on employment contracts, employment manuals, personnel policies and procedures, restrictive covenants, and severance agreements.

  • Goldrich, et al. v. Crecco, et al. (Hudson County 2022) – Awarded summary judgment dismissing Plaintiff’s discrimination, retaliation, civil rights act and whistleblower claims
  • MZM Construction v. N.J. Building Laborers Statewide Benefit Funds (D.N.J. 2022) – Awarded summary judgment that construction company was not signatory to a CBA due to fraud in the execution
  • MZM Construction v. N.J. Building Laborers Statewide Benefit Funds (3d Cir. 2020) – Affirmed the District Court’s enjoining of an arbitration provision
  • Secretary of Labor v. Roy Rock, (O.S.H.R.C. 2021) – Reversed and vacated OSHA citation imposed on concrete contractor
  • Nacirema Demolition, et al. v. N.J. Building Laborers Statewide Benefit Funds, (D.N.J. 2020) – Awarded summary judgment that demolition company was not signatory to a CBA
  • Salinas v. Hospice Comfort Care of New Jersey, et al., (Hudson County 2015) –Awarded summary judgment dismissing Plaintiff’s whistleblower claims
  • Logistics Engineering and Systems Integration Services v. Guerra, et al. (Morris County 2015) – Successfully enforced a Non-Compete Agreement for employer, receiving an award of damages, attorneys’ fees and costs
