Michael’s primary focus is assisting clients in the construction, real estate and manufacturing industries. He represents construction companies of all sizes in various matters including construction defects, contractual disputes, mechanic/construction lien law claims, warranty claims, and public-works project disputes. Michael also reviews and drafts contracts for businesses, project owners, general contractors, subcontractors, and suppliers. Additionally, he serves his clients in defending Division of Consumer Affairs investigations.

Michael is a sophisticated commercial litigator, with significant experience in shareholder-dispute, consumer fraud, products liability, franchise practices, real estate claims and class-action matters.  Whether a client has a dispute with a partner, or has been accused of misleading a consumer, Michael has the requisite experience to handle the matter.  Michael has litigated extensively throughout the courts of New Jersey and New York, as well as each jurisdiction’s federal counterparts.  While Michael employs a resolution-first litigation strategy designed to benefit his clients, he’s not afraid to litigate a case to its conclusion, as reflected by his first-chair trial experience.

In addition to his construction and commercial litigation practice, Michael’s labor and employment practice encompasses most industries and includes representing businesses, directors, officers, and employees in state and federal court against employee claims of unlawful discrimination, harassment, whistleblower, retaliation, and wrongful discharge, wage and hour violations, and breach of employment contracts. Additionally, he advises employers on federal and state wage and hour law issues, including representation in connection with Department of Labor inquiries, investigations, and charges. Michael counsels businesses about all facets of employment law, as well as reviewing and drafting employment contracts, non-solicitation, non-compete, and non-disclosure agreements.

Michael is a retired, eleven-time National Blackbelt League Sport Karate World Champion.

REPRESENTATIVE MATTERS

Each lawsuit handled by Michael depends on its unique facts and particular legal circumstances. The following are a list of results obtained by Michael on behalf of his clients:

  • Haddad Plumbing and Heating, Inc. v. Newburgh Windustrial Supply Co., Inc., 2025 WL 763413, Docket No.: A-0125-23 (March 11, 2025).  Obtained reversal of erroneous summary judgment against contractor where trial court ordered that contractor would never be able to provide its damages.
  • NY United A-1 Construction, Inc. v. J.P. Management, LLC, et al., 2023 WL 2919090 (S.D.N.Y., April 12, 2023). Obtained complete dismissal of action on behalf of client filed in Southern District of New York based upon lack of jurisdiction.
  • Sengebush v. House Values Real Estate School, LLC, 2021 WL 343435 (App. Div. 2021) – Obtained reversal of trial court ruling, on a motion to compel arbitration by a putative employer, that plaintiff was an independent contractor and not an employee as a matter of law.
  • Successful in trying a multiple-day bench trial in 2018 on behalf of a commercial food supplier.
