Amendments to Municipal Land Use Law Incorporates Requirements for Electric Vehicle Charging Stations

On July 9, 2021, Governor Murphy signed into law S3223, amending the Municipal Land Use Law (MLUL) to streamline permitting for electric vehicle charging stations (EVCS). The new law establishes numerical standards and zoning standards for the installation of EVCS and charging-ready parking spaces.

Moreover, S3223 expands the MLUL’s definition of “inherently beneficial use” to include electric vehicle charging infrastructure. EVCS are also now permitted accessory uses and a permitted accessory structure in all zoning districts of a municipality. The law also requires applications for new commercial and residential development and for modifications to existing buildings to incorporate EVCS.
