Joseph M. Gorrell, Member in the firm’s Healthcare Law practice, successfully represented our client in an administrative hearing challenging the denial of Medicare coverage for life-saving medication for the cancer patient.
The case centered on a patient battling two distinct mutations of her genes, each requiring a targeted drug therapy as part of a comprehensive treatment plan. When the insurance company initially denied coverage for the medication, the patient’s access to critical, potentially life-extending care was put in jeopardy. Joseph stepped in to guide the client through the appeals process, working closely with the patient’s oncologist to prepare him and guide him through his testimony at the hearing, presenting a clear, medically grounded explanation of how each drug would function within the patient’s individualized treatment plan. That preparation and guidance proved decisive. The matter concluded in a stipulated decision by the Administrative Law Judge after the insurance company representative, hearing the testimony, conceded that coverage of the medication was warranted, reversing the denial and securing the patient’s access to the medication.
