Litigation Associate Autumn McCourt Secures Significant Victory for Contractor

Brach Eichler Litigation Associate Autumn McCourt represented a contractor on a commercial construction project who was not paid on the project by another contractor. Our client did not give up his quest for compensation and, with McCourt at the helm, stayed the course demanding full payment and attorneys’ fees under the New Jersey Prompt Payment Act, a relatively new statute in construction law.

After winning summary judgment on the breach of contract claim, there was a trial on the New Jersey Prompt Payment Act claim and a construction lien foreclosure claim. McCourt defeated the defendant in a two-day bench trial and the Judge ruled the same day as the case closed, awarding our client full relief under the Prompt Payment Act and attorneys’ fees and costs.

This was a significant victory that sets the groundwork for other unpaid contractors to proceed forward under this statute.
